Terms of Service
These Terms of Service ("Terms") govern the website services provided by Azurv ("Azurv," "we," "us"). By subscribing, checking the agreement box at checkout, or using our services, you ("Client," "you") agree to these Terms. If you are agreeing on behalf of a business, you confirm you have authority to bind that business.
The short version: $149 per month, no setup fee, no contract. We design, host, secure, maintain, and update your website. Cancel anytime from your client portal; your website stays live through the end of the month you paid for. Your content is yours. The website design and code are licensed to you while you subscribe.
1. The Azurv Website Plan
The Azurv Website Plan ("Plan") includes the design, writing, and launch of a custom informational website for your business, plus ongoing hosting, SSL, security monitoring, backups, maintenance, performance and search-engine-friendly technical setup (page titles, descriptions, and a sitemap), domain management as described in Section 8, technical support, and routine content updates. The details of your subscription, including any optional add-ons you choose, are shown at checkout and in your confirmation email.
Before launch, we refine your website with the revisions reasonably needed to complete the agreed design. We provide a search-engine-friendly foundation, but no one can guarantee search rankings, traffic, or results, and we do not.
2. Updates & what’s included
Routine updates are included while your Plan is active. These are changes to your existing website such as editing text, replacing images, updating business hours or contact details, updating existing services, and similar minor content changes. Request them from your client portal or by email, and we handle them within a reasonable time on business days.
Larger projects are reviewed first. A full redesign, new custom functionality, online stores or booking systems, custom integrations with other software, or large-scale content writing go beyond routine updates. We’ll review the request and, if we can take it on, tell you any cost before starting. Nothing is ever added to your bill without your approval.
3. Price & billing
The Plan costs $149 per month. There is no setup fee. Your first month is charged when you subscribe, and your Plan then renews on the same day each month. Optional add-ons are never preselected; if you choose any, their prices are shown before you pay and they are billed together with your Plan.
Payments are processed by Stripe. We never see or store your full card number. You can update your payment method, view invoices, and download receipts from your client portal.
If a payment fails, our payment processor will retry it and we will let you know by email so you can update your card. If a payment remains unpaid for 14 days after our notice, we may pause your website until the account is brought current. We will give you at least 30 days’ notice by email before any change to your monthly price.
4. Automatic renewal & cancellation
Your Plan renews automatically every month at $149 (or the price in effect after any notice under Section 3), charged to your payment method on file, until you cancel. There is no minimum term.
Cancel anytime, online. Sign in to your client portal and choose Cancel plan, or email contact@azurv.com. No reason is required, and asking why is always optional. Cancellation takes effect at the end of your current paid month; you will not be charged again, and we will confirm your cancellation and its effective date by email. You can undo a cancellation from your portal any time before it takes effect.
5. Refunds
Monthly fees are not refunded, including for partial months; when you cancel, your website stays live through the end of the month you already paid for. One-time add-on fees are non-refundable once work on them has begun. If we ever charge you in error, we will refund the mistaken charge.
6. Ownership & license
Your content is yours. You keep ownership of your business name, logos, trademarks, photos, text, and other materials you provide to us ("Client Content"). You grant Azurv a license to use Client Content as needed to build, host, and maintain your website.
Our work is licensed to you. Azurv owns all rights in the website design, layout, code, templates, design system, platform components, graphics we create, and other materials we produce ("Azurv Materials"). While your Plan is active and your account is in good standing, we grant you a non-exclusive, non-transferable license to use the Azurv Materials as your website. The Azurv Materials are licensed, not sold, and website files, source code, and design files are not transferred to you. You may not copy, reproduce, or recreate the Azurv Materials, including from the live website or screenshots, for use elsewhere.
Unless you tell us otherwise in writing, we may show your website in our portfolio.
7. When your plan ends
- Your website goes offline at the end of your last paid month, and hosting, your contact form, backups, monitoring, and updates stop.
- Your content: on request within 30 days after your Plan ends, we will send you copies of your Client Content (your text and the photos and logos you provided) as standard document and image files.
- Your domain: see Section 8.
- Data deletion: after those 30 days we may delete your website, Client Content, and related files from our systems. Billing records are kept as required by law.
8. Domains
Domains we register for you. If we register a web address (domain) for your website, Azurv purchases it, registers it in Azurv’s account, and handles its setup, DNS, and yearly renewals while your Plan is active, at no extra charge. When your Plan ends we stop renewing it. If you would like to keep the domain, ask us within 30 days after your Plan ends and, as a courtesy to our clients, we will transfer it to you or to the registrar you choose at no charge, provided your account is paid in full. Domain registries may block transfers for up to 60 days after a domain is registered or transferred. After a transfer, renewals are your responsibility.
Domains you already own. You keep your domain with your current registrar and remain responsible for its renewal. You point it to our servers (we can do this for you with access you provide), and we manage everything else from our side.
9. Your content & responsibilities
You are responsible for the accuracy of the information on your website, including services offered, pricing, licensing details, and contact information, and for complying with laws and regulations that apply to your business and its advertising. We publish content as you approve it; please review your website carefully before launch and after updates.
You confirm you have the rights to all Client Content you provide, including photos.
10. Acceptable use
You agree not to use our services for unlawful, fraudulent, misleading, infringing, hateful, or harmful content, to collect information from visitors without their consent, or to send spam. We may pause or end service for serious or repeated violations, after notice where reasonable.
11. Free website previews
Azurv creates free, no-obligation website previews to show businesses what their website could look like. Requesting a preview does not require payment or a credit card and does not create a subscription. Previews are concepts only: their text, photos, and details are illustrative placeholders, not statements by or about the business, and they are not published as the business’s official website. Previews are shown as-is (revisions begin after you subscribe), remain the property of Azurv, and may not be copied or used without subscribing. Previews may be removed at any time.
12. Third-party services
We use trusted third parties to provide our services, including Stripe for payments, hosting and network providers, domain registrars, and email delivery services. Their availability and terms are outside our control, but we choose reputable providers and handle the relationship for you.
13. Availability & support
We work to keep your website online, secure, and backed up, but we do not guarantee uninterrupted availability. Hosting providers, networks, and third-party services can experience outages beyond our control. Support and update requests are handled by email and through your client portal within a reasonable time on business days.
14. Liability
Our services are provided "as is" to the fullest extent permitted by law. Azurv is not liable for indirect, incidental, or consequential damages, including lost profits or lost business. Our total liability for any claim relating to our services is limited to the amount you paid us in the 3 months before the claim arose.
15. General
We may update these Terms from time to time. If we make a material change, we will notify active clients by email at least 30 days before it takes effect. These Terms are governed by the laws of the State of California. If any part of these Terms is found unenforceable, the rest remains in effect. Our Privacy Policy explains how we handle personal information.
